Under-trials and jail term: how do you react to these?

Some say that if the jail term a convict is awarded is equal or less than the time s/he had spent behind bars between conviction and real trial, s/he should be freed right-way, while others say the court verdict is to be carried out as it is, no matter how much time one had been an under-trial – under-trial is a convict who awaits court hearing to prove his position, guilty or not guilty.

How do you react to these two views on under-trials and court verdict? .
